Two Luzerne men arraigned on drug delivery charges


A lengthy investigation by the Strike Team Investigative Narcotics Group has culminated in the arrest of two Luzerne men for delivery of controlled substances.

Cory McIntyre, 37, and Timothy Fuller, 56, were arrested Dec. 22 for allegedly selling drugs in the Mio area, according to a STING press release.

McIntyre was charged with one count of delivery of heroin, and Fuller was charged with one count of delivery of morphine and one count of aiding and abetting the delivery of heroin. Both men were charged as fourth offense habitual offenders.

According to the felony complaint, McIntyre faces up to 20 years and/or $25,000 for the delivery charge.

McIntyre was previously convicted in 18th Circuit Court in Bay County of possessing a controlled substance of less than 25 grams in 2011. He was also convicted of conspiracy to deliver and manufacture a controlled substance in 2013 in Oscoda County’s 23rd Circuit Court. McIntyre was also convicted of attempted assault by strangulation in 23rd Circuit Court.

According to the felony complaint, Fuller faces 20 years and/or $25,000 for the aiding and abetting charge, and 20 years and/or $25,000 for the delivery charge.

Fuller was convicted of false pretenses greater than $100 and conspiracy — false pretenses greater than $100 in 1997 in the 10th Circuit Court for Saginaw. Fuller was also convicted of embezzlement in 1997 in 10th Circuit Court.

Due their habitual offender status, McIntyre and Fuller could each face up to life in prison if the primary offense has a penalty of five years or more. If the primary offense entails five years or less, they could face up to 15 years in prison.

Both McIntyre and Fuller were lodged in Ogemaw County Jail and were given a $750,000 bond at their arraignment.
